By accessing our website, placing an order, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services or access our website. These Terms apply to all users of our services, including without limitation users who are browsers, customers, merchants, contributors of content, or other users of the service.

- Same-day and scheduled delivery services within Tokyo metropolitan area

- Luxury gift packaging and presentation services
- Care instructions and maintenance guidance for arrangements
All services are subject to availability, seasonal variations, and our professional standards. We reserve the right to modify or discontinue any service at any time without prior notice.
Eligibility and Account Requirements
To use our services, you must:
- Be at least 18 years of age or have parental/guardian consent
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Be responsible for maintaining the confidentiality of your account credentials
- Accept responsibility for all activities that occur under your account

Orders and Payment Terms
Order Placement and Acceptance
Orders can be placed through the following methods:

- Through authorized representatives or corporate accounts
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.
Pricing and Fees
- All prices are listed in Japanese Yen (¥) and are subject to change without notice
- Prices include arrangement creation and standard delivery within Tokyo
- Additional fees may apply for rush orders, extended delivery areas, or special services
- Corporate clients may be eligible for volume discounts and special pricing
- Seasonal price variations may apply based on rose availability and market conditions
- All prices are inclusive of applicable taxes unless otherwise specified
Payment Terms
- Payment is required in full at the time of order placement
- We accept major credit cards (Visa, MasterCard, American Express, JCB)
- Bank transfers and corporate accounts available for qualified customers
- All payments are processed securely through authorized payment providers
- Payment confirmation is required before order processing begins
- Currency conversion fees may apply for international payment methods
Order Modifications and Cancellations
- Orders may be modified up to 4 hours before scheduled delivery time
- Cancellations accepted up to 24 hours before delivery (full refund)
- Cancellations made 12-24 hours before delivery incur a 25% cancellation fee
- Cancellations made less than 12 hours before delivery incur a 50% cancellation fee
- Same-day orders cannot be cancelled once processing has begun
- Custom or special-order arrangements may have different cancellation policies
Delivery Terms and Conditions
Delivery Areas and Scheduling
- Standard delivery available throughout Tokyo metropolitan area
- Extended delivery available to surrounding prefectures (additional fees apply)
- Same-day delivery for orders placed before 2:00 PM JST (subject to availability)
- Scheduled delivery available up to 30 days in advance
- Delivery time windows: Morning (9:00-12:00), Afternoon (13:00-17:00), Evening (18:00-20:00)
- Specific delivery time requests accommodated when possible but not guaranteed
- Holiday and weekend delivery available with advance notice
Delivery Requirements and Procedures
- Recipient or authorized person must be available to receive delivery
- Valid delivery address and contact information required
- Photo identification may be required for high-value deliveries
- Delivery confirmation provided via SMS or email
- Special delivery instructions must be provided at time of order
- Access to delivery location must be safe and legally permissible
Failed Delivery and Re-delivery
- Three delivery attempts will be made on the scheduled delivery date
- Customer will be contacted for each failed delivery attempt
- Re-delivery fees apply for failed deliveries due to customer unavailability
- Arrangements may be left in a safe location at customer's written request
- Perishable arrangements cannot be held for extended periods
- Customer assumes responsibility for arrangements after successful delivery

We maintain high standards for the freshness and quality of our arrangements according to the following practices:
- All roses are hand-selected for exceptional beauty and freshness
- Arrangements are created using professional techniques and premium materials
- Quality control inspection performed before every delivery
- Arrangements designed to maintain freshness for optimal duration from delivery
- Professional presentation and packaging standards maintained
Customer Satisfaction
- We strive for customer satisfaction on all arrangements
- Quality concerns should be reported within 24 hours of delivery
- Photo evidence may be required for quality claims
- Replacement or refund available for legitimate quality issues at our discretion
- Seasonal variations in flower appearance are considered normal
- Minor substitutions may be made to maintain quality and availability
Care Instructions and Longevity
- Detailed care instructions provided with every arrangement
- Customer responsible for proper care after delivery
- Longevity depends on environmental conditions and care provided
- Quality claims may be affected if care instructions are not followed
- Additional care products and services available upon request
Limitation of Liability
Rose Elegance's liability is expressly limited to the following terms:
Maximum Liability
- Total liability limited to the cost of the specific floral arrangement in question
- No liability for indirect, incidental, or consequential damages
- No liability for lost profits, business interruption, or emotional distress
- Liability limitations apply regardless of the form of action (contract, tort, etc.)
Exclusions from Liability
We are not responsible for:
- Delays caused by weather, natural disasters, or acts of God
- Traffic conditions, road closures, or transportation issues beyond our control
- Damage to property during delivery (unless due to gross negligence)
- Allergic reactions to flowers, pollen, or plant materials
- Recipient's unavailability or incorrect delivery information provided by customer
- Theft or damage occurring after successful delivery
- Changes in flower appearance due to natural aging or environmental factors
- Emotional or sentimental value of arrangements
- Third-party actions or omissions
- Force majeure events including but not limited to pandemics, strikes, or government actions
Intellectual Property Rights
All intellectual property rights related to our services and content are protected:
- All website content, including designs, images, and text, is proprietary to Rose Elegance
- Floral arrangement designs and concepts are protected by copyright and trade dress
- Rose Elegance name, logo, and branding are protected trademarks
- Customer may not reproduce, distribute, or create derivative works without written permission
- Photography of our arrangements for commercial use requires explicit consent
- Customer grants us permission to photograph and use images of delivered arrangements for marketing
- Any customer-provided content becomes our property for business use
Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to:
- Collection and processing of personal information as described in our Privacy Policy
- Use of cookies and tracking technologies on our website
- Communication via phone, email, and SMS for service-related purposes
- Storage of order history and preferences for improved service
- Sharing of information with service providers necessary for order fulfillment
Dispute Resolution
Informal Resolution
Before pursuing formal legal action, parties agree to attempt informal resolution:
- Customer must contact us directly to discuss any disputes or concerns
- We will make good faith efforts to resolve issues within 14 business days
- Documentation of the dispute and resolution attempts must be maintained
Governing Law and Jurisdiction
- These Terms are governed by the laws of Japan
- Any legal disputes will be resolved in the courts of Tokyo, Japan
- Customer consents to personal jurisdiction in Tokyo courts
- Japanese law applies regardless of customer's location
Alternative Dispute Resolution
- Parties may agree to binding arbitration for certain disputes
- Mediation services available through recognized Japanese mediation organizations
- Class action lawsuits are waived in favor of individual dispute resolution
Termination and Suspension
We reserve the right to terminate or suspend services under the following circumstances:
- Violation of these Terms of Service or our policies
- Fraudulent activity or suspected illegal behavior
- Abusive or threatening behavior toward our staff
- Repeated failed payments or chargebacks
- Providing false or misleading information
- Business closure or discontinuation of services
- Force majeure events preventing service delivery
Upon termination, all outstanding orders will be handled according to our standard policies, and any prepaid amounts for undelivered services will be refunded.
Miscellaneous Provisions
Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and Rose Elegance regarding the use of our services.
Assignment
You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms without restriction.
Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, government actions, labor disputes, or other force majeure events.
